    Journalists welcome decree against Mian Amir, Dunya TV

    Lahore court has decreed against Mian Amer Mahmood and Dunya News TV channel for violating a contract signed with former Director News Absar Alam and has ordered the channel and its management to immediately pay off his dues with interest and the income tax payment certificate. In this landmark decision, the court of Civil Judge Syed Faheem Shahid, also dismissed a false claim of Rs.222 million (Rs.22 crores) filed by Mian Amer to pressurize the plaintiff to withdraw the case, in an attempt to deny the lawful dues of Absar Alam.

    In addition to payment of outstanding dues, the court has also ordered Mian Amer to pay Absar Alam additional amount equivalent to 14 percent of the total dues as compensation. The court also declared Dunya management’s denial to pay a working journalist’s dues as 'malafide.' 'Due to the defendant’s (Mian Amer and Dunya News) malafide in making this payment, the defendants must also pay the accrued profit/mark-up for the default period at the rate of 14 % per year starting from 25.05.2009 till date,'; the court order said.

    The court has also ordered the issuance of tax payment certificate to Absar Alam for the period he had worked for Dunya to establish whether Mian Amer had been paying the income tax to the public exchequer which was duly deducted from Absar’s salary at source every month. The case was filed by Absar Alam in December 2009 in the Civil Court Lahore. Absar had resigned in May 2009 and had been waiting for Mian Amer and Dunya News to settle his dues which they did not following their notorious tradition of denying working journalists their rights. Mansoor Awan and Saad Rasool advocates represented Absar in the case.

    Journalists bodies across Pakistan, senior journalists, anchor persons and human rights activists have hailed the decision and hoped it would set a trend for working journalists to get their dues form the owners of media channels who are in the habit of violating the contracts and denying rights to the outgoing employees..

    World Press Freedom Day: Decree against TV channel welcomed

    ISLAMABAD:

    Journalists working from various media organisations and journalists’ representative bodies welcomed the landmark court decree against Dunya News and termed it a “gift” on World Press Freedom Day.

    A Lahore court decreed against Dunya News TV channel and its proprietor for violating a contract signed with former Director News Absar Alam and ordered the channel and its management to immediately pay off his dues with interest and also give Alam his due income tax payment certificate.

    In its decision, the court of Civil Judge Syed Faheem Shahid, also dismissed a claim of Rs222 million filed against Alam.

    In addition to payment of outstanding dues, the court has also ordered to pay Absar Alam additional amount equivalent to 14% of the total dues as compensation. The court also declared Dunya management’s denial to pay a journalist’s dues as “malafide.”

    President Pakistan Federal Union of Journalists, Pervez Shaukat welcomed the decision and said it would be a milestone in the history of journalists’ struggle in electronic as well as print media.
